Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and One Stone sp. z o.o., a company registered under the laws of the Republic of Poland ("Zevlian," "we," "us," or "our"). These Terms govern your access to and use of the Zevlian platform, including our website, mobile applications, APIs, and all related services (collectively, the "Services").

Please read these Terms carefully before using our Services. By accessing or using Zevlian, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

1. Acceptance of Terms

By creating an account, accessing, or using any part of the Services, you agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions that may apply to specific features or services offered by Zevlian. If you do not agree to these Terms, you must not access or use our Services.

Your continued use of the Services following the posting of any changes to these Terms constitutes your acceptance of such changes. We reserve the right to modify these Terms at any time, and it is your responsibility to review them periodically.

2. Eligibility

To use Zevlian, you must meet the following eligibility requirements:

1. You must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater.
2. You must have the legal capacity to enter into a binding agreement under applicable law.
3. You must not be located in, or a citizen or resident of, any jurisdiction where the use of cryptocurrency services is prohibited or restricted by law.
4. You must not be listed on any sanctions list maintained by the European Union, the United Nations, the United States (OFAC), or any other applicable governmental authority.
5. You must not have been previously suspended or removed from using the Services.

By using the Services, you represent and warrant that you meet all of the foregoing eligibility requirements. Zevlian reserves the right to verify your eligibility at any time and to refuse service to any person or entity that does not meet these requirements.

3. Account Registration

To access the full functionality of the Services, you must register for an account. During registration, you agree to:

1. Provide accurate, current, and complete information as requested during the registration process.
2. Maintain and promptly update your account information to keep it accurate, current, and complete.
3. Maintain the security and confidentiality of your login credentials, including your password and any two-factor authentication codes.
4. Immediately notify Zevlian of any unauthorized use of your account or any other breach of security.
5. Accept responsibility for all activities that occur under your account, whether or not authorized by you.

As part of our regulatory obligations, we may require you to complete identity verification procedures (Know Your Customer, or KYC) before granting access to certain features. You agree to provide any documentation or information requested for this purpose, including government-issued identification, proof of address, and other relevant documents.

Zevlian reserves the right to refuse registration, suspend, or terminate any account at its sole discretion, particularly where there is a reasonable suspicion of fraudulent activity or non-compliance with these Terms.

4. Description of Services

Zevlian provides a digital platform that enables users to interact with the XRP Ledger (XRPL). Our Services include, but are not limited to:

4.1 XRP Wallet Services

Zevlian provides a non-custodial or custodial digital wallet that allows you to store, manage, and view your XRP holdings. Your wallet interacts directly with the XRP Ledger to reflect your current balance and transaction history.

4.2 Sending and Receiving XRP

You may use the Services to send XRP to other XRPL addresses and to receive XRP from other users or external sources. All transactions are executed on the XRP Ledger and are subject to the network's consensus mechanism. Zevlian does not guarantee the reversal of any transaction once it has been submitted to the network.

4.3 Buying and Selling XRP

Zevlian facilitates the purchase and sale of XRP through partnerships with licensed third-party payment providers and exchanges. When you buy or sell XRP through the platform, you may be entering into a separate agreement with the relevant third-party provider. Zevlian acts as an intermediary to facilitate these transactions but is not itself a party to the exchange unless explicitly stated.

The availability of buy and sell features may vary depending on your jurisdiction, the completion of identity verification, and the operational status of our third-party partners.

5. User Obligations

As a user of Zevlian, you agree to the following obligations:

1. Compliance with Laws. You shall comply with all applicable local, national, and international laws and regulations in connection with your use of the Services, including but not limited to anti-money laundering (AML) regulations, tax laws, and sanctions requirements.
2. Accurate Information. You shall provide truthful and accurate information at all times and shall not misrepresent your identity, qualifications, or affiliations.
3. Security. You are responsible for maintaining the security of your account credentials and any devices used to access the Services. You must use strong, unique passwords and enable two-factor authentication where available.
4. Reporting. You shall promptly report to Zevlian any suspicious activity, security breaches, or unauthorized access to your account.
5. Tax Obligations. You are solely responsible for determining and fulfilling your tax obligations arising from your use of the Services. Zevlian does not provide tax advice and is not responsible for your tax reporting or payments.

6. Prohibited Activities

You agree not to use the Services for any unlawful, fraudulent, or harmful purpose. Without limiting the foregoing, the following activities are strictly prohibited:

1. Fraud. Engaging in any fraudulent activity, including but not limited to identity theft, phishing, social engineering, or the use of stolen financial instruments.
2. Money Laundering. Using the Services to launder the proceeds of criminal activity or to disguise the origin, ownership, or destination of funds in violation of applicable anti-money laundering laws and regulations.
3. Terrorism Financing. Using the Services to finance or support terrorism, terrorist organizations, or any activities that threaten public safety or national security.
4. Sanctions Evasion. Using the Services to evade or circumvent economic or trade sanctions imposed by the European Union, the United Nations, or any other applicable governmental authority.
5. Market Manipulation. Engaging in market manipulation, wash trading, spoofing, layering, or any other activity designed to artificially influence the price or trading volume of XRP or any other digital asset.
6. Unauthorized Access.Attempting to gain unauthorized access to the Services, other users' accounts, or any systems or networks connected to the Services.
7. Reverse Engineering. Decompiling, disassembling, reverse engineering, or otherwise attempting to derive the source code of the Services or any component thereof.
8. Abuse of Service.Using the Services in a manner that could damage, disable, overburden, or impair the Services or interfere with any other party's use of the Services, including through the use of automated scripts, bots, or scraping tools without prior written authorization.
9. Illegal Goods and Services. Using the Services to facilitate or participate in the purchase or sale of illegal goods or services, including narcotics, weapons, counterfeit goods, or stolen property.

Zevlian reserves the right to investigate any suspected violations of these prohibitions and to take appropriate action, including suspending or terminating your account, reporting suspicious activity to the relevant authorities, and cooperating fully with law enforcement investigations.

7. Fees and Charges

Zevlian may charge fees for certain Services, including but not limited to transaction fees, network fees, conversion fees, and withdrawal fees. The applicable fee schedule is made available within the platform and may be updated from time to time at Zevlian's discretion.

You acknowledge and agree that:

1. All fees are disclosed prior to the execution of a transaction, and by confirming a transaction, you agree to pay the stated fees.
2. Exchange rates applied to conversions may vary and are determined at the time of execution. Rates displayed prior to confirmation are indicative and may differ from the final executed rate.
3. Third-party service providers involved in processing your transactions (such as payment processors, banks, or exchange partners) may impose their own fees, which are separate from and in addition to any fees charged by Zevlian.
4. XRP Ledger network transactions require a small amount of XRP to be held as a reserve and may incur network transaction costs, as determined by the XRPL protocol.
5. Zevlian reserves the right to modify its fee structure at any time. Material changes to fees will be communicated to you in advance through the platform or via email.

8. Exchange Rates

Exchange rates displayed on the Zevlian platform are sourced from the XRP Ledger's decentralized exchange and other market data providers. You acknowledge and agree that:

1. Exchange rates are indicative and are provided for informational purposes only. They do not constitute an offer, solicitation, or guarantee of any particular rate.
2. The final exchange rate applied to your transaction may differ from the rate displayed at the time of your order due to market volatility, liquidity conditions, or processing delays.
3. Zevlian does not guarantee the availability of any particular exchange rate or trading pair at any given time.
4. You assume all risk associated with exchange rate fluctuations. Zevlian shall not be liable for any losses arising from changes in exchange rates between the time you initiate a transaction and the time it is executed.
5. Exchange rates may include a spread or markup applied by Zevlian or its third-party partners, which is incorporated into the displayed rate.

9. Intellectual Property

All intellectual property rights in and to the Services, including but not limited to the software, design, text, graphics, logos, icons, images, audio clips, data compilations, and the arrangement thereof, are owned by or licensed to One Stone sp. z o.o. and are protected by applicable copyright, trademark, patent, and other intellectual property laws.

The Zevlian name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of One Stone sp. z o.o. or its affiliates. You must not use such marks without our prior written permission.

Subject to your compliance with these Terms, Zevlian grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes. This license does not include the right to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Services.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Zevlian, its directors, officers, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:

1. Your access to, use of, or inability to access or use the Services.
2. Any conduct or content of any third party on or related to the Services, including any defamatory, offensive, or illegal conduct of other users or third parties.
3. Any unauthorized access to, use of, or alteration of your transmissions or content.
4. The value or price fluctuation of XRP or any other digital asset.
5. Any errors, bugs, or vulnerabilities in the XRP Ledger or any blockchain network utilized by the Services.
6. Any failure, delay, or interruption in the Services caused by factors beyond our reasonable control, including network outages, regulatory actions, or force majeure events.

In no event shall Zevlian's total aggregate liability to you for all claims arising out of or relating to these Terms or the Services exceed the greater of (a) the total fees paid by you to Zevlian during the twelve (12) months preceding the event giving rise to the liability, or (b) one hundred euros (EUR 100).

The limitations set forth in this section shall apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, and even if Zevlian has been advised of the possibility of such damages.

11. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Zevlian disclaims all warranties, including but not limited to:

1. Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
2. Any warranty that the Services will be uninterrupted, timely, secure, or error-free.
3. Any warranty regarding the accuracy, reliability, or completeness of any information provided through the Services.
4. Any warranty that defects in the Services will be corrected.

You acknowledge that the use of digital assets and blockchain technology involves inherent risks, including but not limited to technological risks, regulatory risks, and market risks. You assume full responsibility for any risks associated with your use of the Services, including any loss of XRP or other digital assets.

Zevlian does not endorse, guarantee, or assume responsibility for any advertisements, offers, or statements made by third parties through or in connection with the Services.

12. Account Suspension and Termination

Zevlian may, at its sole discretion, suspend, restrict, or terminate your account and your access to the Services, in whole or in part, at any time and for any reason, including but not limited to:

1. Violation or suspected violation of these Terms or any applicable law or regulation.
2. Failure to complete identity verification or provide requested documentation within a reasonable timeframe.
3. Suspicious or potentially fraudulent activity detected on your account.
4. A request or order from a law enforcement or regulatory authority.
5. Extended periods of inactivity on your account.
6. Any other reason that Zevlian determines, in its reasonable judgment, necessitates such action to protect the integrity of the Services or the safety of other users.

You may terminate your account at any time by contacting our support team. Upon termination, you must withdraw any remaining XRP balance from your account, subject to applicable fees and any legal holds. Zevlian shall not be liable for any loss or damage arising from the suspension or termination of your account.

Sections of these Terms that by their nature should survive termination shall survive, including but not limited to provisions regarding intellectual property, limitation of liability, disclaimer of warranties, indemnification, and governing law.

13. Modifications to Terms

Zevlian reserves the right to modify, amend, or update these Terms at any time at its sole discretion. When we make material changes to these Terms, we will:

1. Update the "Last updated" date at the top of this page.
2. Provide notice through the platform, via email, or through other reasonable means at least thirty (30) days before the changes take effect, unless a shorter notice period is required by law or necessitated by urgent circumstances.
3. Give you the opportunity to review the revised Terms before they become effective.

Your continued use of the Services after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue your use of the Services and close your account.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of laws principles.

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be submitted to the exclusive jurisdiction of the competent courts of the Republic of Poland.

Notwithstanding the foregoing, if you are a consumer residing in the European Union, you may also have the right to submit a dispute to the online dispute resolution platform provided by the European Commission at https://ec.europa.eu/consumers/odr, or to the competent courts of your place of residence, in accordance with applicable EU consumer protection legislation.
